Gun Control Laws in Louisiana

Gun laws in Louisiana are in place to govern the use, sale, possession, and transfer of firearms in the state. Louisiana is a “Shall Issue” state, and the Louisiana Department of Public Safety and Corrections handles all permits. When buying a gun in Louisiana, the applicant has to wait ten days while the local police and NCIS information from their background check is reviewed. Anyone wanting to buy a firearm also has to prove proficiency in using one and has to take an approved training course. Open carry is permitted for anyone 17 or older, but you cannot bring guns into any place that serves alcohol. To apply for permits you need to visit the state police. There are a lot of stipulations about where you cannot carry including schools, courthouses, police stations, government buildings, parts of an airport and churches. Louisiana issues carry permits for its residents but not non-residents. Louisiana offers free licenses to honorably discharged members of the military.

Louisiana’s policy is Shall Issue in practice and its license is issued to residents. You can carry a handgun in: state parks, state and national forests, road side rest areas, vehicle, all areas of the state not listed as forbidden.

Louisiana Concealed Carry Permit and Laws

Louisiana is a “Shall Issue” state and offers its residents only gun permits for reciprocity reasons and concealed carry. The state offers open carry without a permit also. You are allowed to carry a gun in your vehicle in Louisiana with or without a permit. However, if you encounter a police officer, you must notify them that you are armed. You do need to respect all “no weapons” signs; they are legally enforced. The state of Louisiana allows open carry at age 17, but federal law requires citizens to be 18 or older. You can carry weapons into restaurants that serve alcohol unless they have a “no guns” sign. You cannot, however, carry into bars. You are allowed to carry in state parks and wildlife preserves. Louisiana is not a constitutional carry state.

CCW Eligibility: Qualify or Pre-Qualify?

To apply for a gun permit in Louisiana, you must be twenty-one years old. You must also take an approved gun-training course and prove that you are able to handle it. You have to be a legal U.S. citizen and a resident of Louisiana. You cannot have any misdemeanor convictions for drugs. You also cannot have committed any violent crimes or have been in prison. Your previous permit cannot have been revoked any time during the previous four years. If you have been denied a license within the past year, you will also not be able to apply again. You will have to pay a $125 fee when applying unless you are 65, then the price drops to $62.50. You are not allowed to carry in schools, churches, polling stations, government buildings, parts of airports, parades or demonstrations, state buildings, police stations, detention centers, jails, and prisons.

Louisiana Gun Background Check

Louisiana is not a “point of sale” state, and they do not require a state-level background check. Gun dealerships are required to perform a federal background check using the NCIS system to gather information. As long as a background check was completed and approved for a gun permit, CCW holders are exempt from having one performed when they purchase a gun at a licensed dealership. This waiver applies only to people who have obtained a permit after March of 2015. Any permits older than that will have to undergo a new background check.

State Concealed Carry Requirements

  • Must be at least 21 years old

  • Be a resident of the state of Louisiana
  • You are a US citizen
  • Not have been convicted of a misdemeanor in this or any other state relating to a controlled dangerous substance within the last five years.
  • Not have been convicted of a crime of violence within the last five years.
  • Not have been convicted of a crime of violence or any crime punishable by imprisonment for a term of one year or greater. However, a person who has been convicted of a violation of 18 U.S.C. 491(a) shall be permitted to qualify for a concealed handgun permit if fifteen or more years has elapsed.
  • Not have had a permit revoked within four years prior to the most recent application.
  • Not have had a permit denied within one year prior to the most recent application.

Gun CCW Permit Application

  1. Complete a firearms training course.
  2. Download the application form or make an online application
  3. You will need some of the following documents; Application with the 3 affidavits completed and notarized. Copy of Louisiana Driver’s License or Louisiana Identification Card. Copy of Louisiana permanent injunction or the protective order. (If Applicable) Correct Fee as described in Rule Booklet. Proof of Training as described in Rule Booklet. Two sets of fingerprints on an FBI Applicant Card. If the fingerprints were taken electronically, they must be on two separate cards. Marital Status – If you are divorced, copies of the divorce settlement, decree, or final judgment along with any orders or injunctions of the court must be included. Arrests – If you have been arrested, you must include Certified True Copies of court minutes as requested in “Arrests, Detention, and Litigation Section.” You must still list violations that were EXPUNGED, DISMISSED, or SET ASIDE or for which you were PARDONED. Military – If you have served in the Armed Forces of the United States, you must include a copy of your DD-214. If you are currently serving in the Armed Forces of the United States, you must include a copy of your current orders or a copy of your military ID if allowed. Medical Summary Disposition – If you answered “yes” to any of the medical questions #13-19, the Medical Summary must be completed by the treating physician. This information MUST be included with your application.
  4. Contact your local police office, local sheriff’s department, or State Police Headquarters in Baton Rouge for fingerprinting.

  6. You will be notified by mail if your application has been approved.

CCW Renewal

  • Additional refresher training is required for all permit renewal applications.
  • You will be notified by mail about 120 days before the expiration date on your permit.
  • A renewal application must be submitted within 60 days of the expiration date.
  • A new permit application is required if the permit expired over 60 days.
