Gun Control Laws in Idaho

As of March in 2016, the state of Idaho allows concealed carry throughout the state. Before that, concealed carry without a permit was only allowed outside cities, but this new law now includes cities. Idaho is a "Shall Issue" state and the county sheriff issues licenses within 90 days. You may have to take a certified gun course before applying and prove you can handle one. According to Idaho gun laws, no permits are required to purchase or own a handgun, rifle or shotgun. It is against Idaho gun law to sell to a minor (anyone under the age of 18). When you have a CCW, you can carry in your vehicle, but you cannot have any concealed weapons on you if you are drinking alcohol or have taken drugs. Minors below the age of 18 can only legally possess or use a firearm with parental consent. You must be a resident of the state to carry and have lived there for at least six months.

Idaho’s policy is Shall Issue in practice and its license is issued to residents. You can carry a handgun in: state parks, state and national forests, road side rest areas, vehicle, all areas of the state not listed as forbidden.

Idaho Concealed Carry Permit and Laws

The county sheriff’s office issues concealed carry permits in Idaho. After applying you will receive it within 90 days. You are not required to notify an officer that you are carrying either concealed or open. You do not have to observe any “no weapons” signs either. 18 years olds can carry a concealed weapon in their car without a permit as long as they are outside city limits. If within city limits, you must be 21 or older. If without a license then the gun must be out in the open, not concealed. The legal age limit for open carry in the state is 18. You can carry in restaurants or bars and state parks.

To qualify for a CCW in Idaho, you must be 21 or older and a U.S. citizen. You have to take a firearms safety course and prove that you have lived in Idaho for at least six months. You must not have any outstanding judgments against you or have had any misdemeanors within the past three years. You must also follow all federal guidelines.

Idaho Gun Background Check

Since Idaho is not a “point of sale” state, then dealers have no state obligation to run a background check. Therefore, all background checks for firearms purchases must be made through the FBI’s NCIS system. However, people with firearm permits are exempt from the federal background check requirement.

State Concealed Carry Requirements

  • Must be at lease 21 years of age.
  • Are a US citizen.
  • Demonstrate familiarity with the firearm through a course.
  • Resident of Idaho for at least six months.
  • Not the subject of a withheld judgment for a crime prohibiting a carry license; or released pending trial, appeal or sentencing for a crime prohibiting a carry license.
  • Has not been adjudicated guilty of or received a withheld judgment or suspended sentence for one or more crimes of violence constituting a misdemeanor, unless three years has elapsed since disposition.

Gun CCW Permit Application

  1. Do a training course if required.
  2. Download the application form or pickup from your local Sheriffs office.
  3. You will need to take the following documents to your local Sheriffs office; Completed application Proof of training Photo ID
  4. You will be fingerprinted.
  5. You will be informed by mail if your permit has been approved or declined.

CCW Renewal

  • Concealed carry Weapons License’s can be renewed within 90 days before and 90 days after the Expiry date.
  • A new license application must be made if the license has expired for more than 90 days.
